PAC Minutes / June 3 2003

1/ Roger Summers calls meeting to order and motion to approve April minutes. Minutes were approved.

2/ Introduction of Guests: Jason Vasquez from JWA, Hank Lozano from SP2 making presentation on Old Kline Drive, Dave Kiff from City of Newport Beach

3/ Roger Summers remarks:
Street sweeping will change to every Thurs.in East SAH from 8:30 to 12:30 beginning July 3. Also talked about two County-owned parcels for sale in the County Newsletter this month. Open houses are to be held Wed. 6/4/03 – Indus 10 to 12 and Silver Lane 12-2.

Public Comments
1/ Ted Bosley: Is there anything in the bidding process that guarantees the person who buys the property across from him (Indus) will have the money to really fix up the property as it needs to be?

2/ Russ Niewarowski
“A” list projects - no mention of the community center, has the public been polled if they want the center? He does not see this as an “A” list project. He says his West Side area barely has Sheriff Dept and Code Enforcement. He mentions one property in particular in his area.


New Business
Election of officers: This happens at the June meeting every other year. New elections were:

Old Business
1/ Old Kline Drive
Hank Lozano has worked on three proposals for Old Kline Drive.

Proposal A: Is a total re-construction of the street. It will provide sidewalks and a total build out of the street along with parking for homeowners. This will encroach on private property. A 30-foot+ street dedication is required. There is a turn around requirement and that would impact the residents at the cul-de-sac end of the street. This also addresses drainage concerns on the street. When the street is build out, storm drains would need to be built along with other infrastructure improvements.

All proposals would require homeowners to dedicate property to the County for this project. The County would prefer not using eminent domain in the area. The estimate is $200,000 for projected improvements.

If property owners don’t dedicate property, the project does not move forward. Eminent domain can be used by the County, but not by the OCDA. The County feels that this street improvement is a direct benefit to the homeowners and not the County so this does not meet the legal criteria to pay for their property plus make improvements.

Roger asked Dave Kiff if eminent domain would come into play when this becomes Newport Beach. Dave said they have discussed this, and they do feel this area has a safety issue.

Davis Stieve told us that they have been discussing this issue for years. There are code enforcement issues there and safety issues and this project has been stalled in the past due to a few homeowners.

The 2nd proposal B, does not include sidewalks

The 3rd C proposal is the same as above but the cul-de-sac is flopped and pulled further towards Orchard.

Dave Kiff will take these plans to the City of NB and work with them as well.

Hank Lozano recommended that the next step is to get these plans to the homeowners for their input.

Roger made a motion, Richard Moriarty 2nds. Passes unanimously:
Motion proposes that the County send an official letter to all the homeowners involved and ask them to attend a meeting on site that will explain the proposals and get feedback. Mark will go back to the County team and see what they say and how to structure the letter.

Weed Abatement
The property on Birch and Mesa has been done. Richard Moriarity asked Dave Kiff about the three properties in Newport Beach on Mesa Dr. He will email those addresses to Dave.

Staff Reports
Code Enforcement:
20352 Bayview S.A. HGTS. CE030083 (INOPERABLE VEHICLE) this was removed.

20152 BIRCH ST. S.A. HGTS CE020394 this is an empty lot that Cindy Sesma, O.C. Code Enforcement, has been working on for some time and the owner has been cited several times and issued fines. Cindy has been told that the owner is in the process of complying.

1511-1512 ORCHARD DR. S.A. HGTS. CE020484 This home was abandoned, tenants were evicted, the place was mess, trash. They were able to track down the realtor and this was cleaned up, home knocked down and now it is an empty lot.

John Wayne Airport Report
Jason Vasquez: At the last meeting megadata site will not be online until the 1st week of July 2003.

Status of Fire Station at Airport
They are very close to selecting a new contractor for the Fire Station and the airport has filed a lawsuit against the original contractor who did not complete the work he had contracted to do.


Report on Annexation
Dave Kiff reports that homeowners on the East Side will be getting something in the mail about what it means to be annexed to NB in the next two weeks. It will have frequently asked questions as well as phone numbers and web site info. Residents will also get a brochure in the mail about the $40.00 a year paramedic subscription service program.

West Side Annexation Report:
The Newport Beach City Council has instructed their staff to keep working on this and they are in the process and watching the RA and the State taking funds from RA agencies. They are also negotiating with Supervisor Silva’s office re: fire station, regional recreational center. Silva has directed County Staff to work with the city on a list of requirements for transfer of the RA.

Community Center & Fire Station Report
The fire station had three sites in mind, one has been dropped, and the two they are considering is where the strawberry stand is now and the properties around it. That is their priority site. They are also considering the Saywitz property at the end of Birch and Mesa.

The YMCA has received 2 or 3 offers from private developers for more money than it has been talked about with the County. The YMCA has also agreed to assume all maintenance and repair of the property and also assume any loss from operations. They may also offer the residents of SA Hts. a discount on membership. The YMCA is considering putting up to $1 million dollars back into the center in the form of furniture, fixtures and equipment.

Paul Lanning wrote to us today:
“The Board met in closed session and voted to authorize negotiations to acquire both the fire station site and the community center site (YMCA). This is a big step and means that we have the authority to negotiate a deal and bring it back to the Board for approval.”

The Board of Supervisors will meet on June 17th and decide, we hope, to move ahead on details as to who will own the property and authorize County staff to buy property for Regional Recreation Center and Fire Station.
Richard Moriarty made a motion to support the purchase of the YMCA property. Passes unanimously.

Proposed Project Reports/ Budget Meeting Report
Committee meets with Paul Lanning CEO’s office every other month/ Barbara Venezia reported.
Here are updates....

State Funds
Paul Lanning told us that the State of Ca. has taken about $600,000.00 from our Redevelopment Fund to offset the State Budget deficit. They took 75 million statewide from different agencies. July 1st begins the new fiscal year and we can expect another hit to our fund. This time the estimate 120 million statewide. Paul was not concerned about the amount they took from us because we had money in the bank and have continued revenue coming in. The money to the state was taken out of the Agency's Low Mod fund so there was no direct hit to any of the operating funds for SAH or NDAPP. The state would allow agencies to take a loan against their low/mod housing funds to pay the state (it's called an ERAF payment) if they could not come up with enough money otherwise. We did not have to do this, at least not this time.
If we hadn't, they could go after the General Fund of The County.


Undergrounding
Tina Taverna submitted a report to us addressing the formation of the Cypress St. Under grounding Utility District #39. This is NOT a tax assessment district. This is the first step in getting our project underway.

Forming a Utility District enables the conversion of existing aerial
Utility facilities to underground locations. There is also a map of the area in question running down Mesa Drive and Cypress St. This report also includes updated estimated costs for the project. Much higher than the study done by RBF. Her estimate is $2,773,497.60

She also gave us an updated schedule of events that are faster than those of the original consultant. The report also includes the Joanna Futerman estimates for each homeowner to connect their homes to the electrical once the poles are underground. She also indicated that every household would have to comply with the undergrounding. There are no exemptions.

Hopefully in June homeowners will be sent information on this report. After that, the next step is to hold a public hearing on the project and the homeowners will get notice of that as well.

As of July 1 this project is now officially in Newport Beach. That means that we go to the Newport Beach City Council for all of our
approvals and hearings, instead of the Board of Supervisors. Tina assured us that her dept. will keep working this project and moving it along and when and if it transfers to Newport Beach, she will work with their various departments to bring them up to speed so we have a smooth transition.


Bristol Sidewalk
Finally, the revised estimate on the Bristol Street sidewalk to something over 300K, (needs 8-ft. sidewalk from 5 ft. and other issues).

Horse Arena
Plans are complete and now the issue seems to be maintenance and liability. The RA can not use funds to maintain this. The CEO's office is now talking with the City of Newport about this development. Once it is settled, the project can move forward.

Report from Development Committee:
The Jones’s at Cypress submitted plans to add to their property. Mark spoke with Margie Wagener and Bill Melton site planner on this project. The County finds nothing in this project that goes against zoning code or Specific Plan. The County does not believe it can get this in the approval process before the July 1 date and then it would be a Newport Beach project.


Jeff Hamilton makes motion for PAC to approve plans. Peter 2nds. Passes unanimously.
