3 Chairman's Remarks: Glad to see Mark Esslinger back, he was absent last meeting. Mary Slouka filed her paramedic form with the City of Newport and the day she filed, she had to use it for an accident. Roger encouraged everyone to look into the Paramedic program the city offers.
Public Comments (Non-Agenda Items): Limited to 3 minutes each 1/ Bob Hanley :Why are there no minutes passed out at meeting. Mark Esslinger says they are getting too thick. He throws most of them away after each meeting. He suggests people go to web site to read past minutes.
2/ Randy Ranck: he is re visiting the topic of dog kennels. He is frustrated with the kennels and the barking at all hours. He said that the dogs barked about 10 hours on Xmas Eve and Xmas day. The same with New Year's Eve. Randy said that he has narrowed it down to one kennel owner that is not being a good neighbor. Roger suggested that Randy write down the name of the kennel and let him know who it is. He can't promise anything, but he will try and get some resolution. Randy will email that to Roger.
3/ Rita Lorman: She lives in the same area and didn't even know the kennels were there until they put the apartments in. She believes that the folks in the apartments maybe bothering the dogs.
4/ May Ranck: Santa Ana Hts. prostitution. She did a google search on the Santa Ana Hts. and got all these X-rated sites. We gave her the correct address for the web site.
5/ Gary Golson: Lives on Old Kline Drive and since the last PAC meeting his 2nd house was broken into. He wants everyone to know that crime is out there.
Community Report 1 Irvine Avenue Widening Project - Ted Rigoni, Senior Civil Engineer who works in the Road Division, Capital Projects Section; and is the project manager for the Irvine Avenue project. (30 minutes)
The County is planning to widen of Irvine Avenue between Mesa and Bristol, with some transition widening just south of Mesa.
The County is working with the City of Newport Beach on this issue. There is a portion of this plan that is in the unincorporated area and the County has spoken to Costa Mesa as well as this is still under discussion for annexation between the two cities.
Javier Soto is the senior design engineer on this project. The purpose of this project is to improve the traffic circulation and safety to motorist and pedestrians. He went on to explain the improvements and the project.
The project adds an additional lane in each direction (3 through lanes), and a bike lane, as well as sidewalks, raised medians and landscaping. There will also be a bus turn out just along the right side of the street going north on Irvine Ave in the vacinity of the area that is currently a stockpile area.
Coming down Mesa Dr. There will be two-left turn lanes and one straight-ahead and right turn lane.
Project funding is coming from the County OCTA Measure M funds and the City of Newport Beach will fund the portion that is in their city. Mesa Dr. heading towards Santa Ana Ave., that portion has not been funded yet. Ted is going back to the County to secure that funding. If that is not received, that portion of the project will have to wait for another time.
The project will take approximately 2 ˝ years to get the approvals, funding, plans etc. The project will take about 9 months to complete once construction starts.
No right-of-way acquisition is required south of Mesa, and the Anniversary Tract, the Mira Loma town homes, and the homes along Irvine Ave. aren't affected.
The County is currently looking at how this will impact the golf course, including part of their parking lot. Ted Ragoni said that he does not want the owner to lose any parking.
Peter Macdonald made a motion to approve this project with a caveat that the City of Newport Beach or Costa Mesa improves the roadway material stockpile site with finished landscaping. We recommend that the County look into amending the application to OCTA to include South Bristol St. Sidewalk. Greg 2nds the motion Motion passes.
Staff and Committee Reports:
1.Report from JWA - Jason Vasquez (5 minutes) He has nothing to report on JWA.
Rick asked about the Slope and Jason has heard that maybe the City of Costa Mesa will clean that up even though it is Cal Trans property.
2.Report on Community Center - Barbara V. (15 minutes) Dave Kiff: City Manager Homer Bludau has met with the Y folks at least twice at the end of the year. The Y should receive an offer shortly. A letter has been drafted by Homer and sent.
(Committee meeting from the Budget meeting notes) The committee and Supervisor Silva feel that the city should stay within the 4.0 budget and should give the YMCA no less than a 3-year agreement. The thinking is that the first year will be tied up with plan approvals, architectural drawings and the building and bidding process for each of these steps. We will be lucky to see construction start by mid 2nd year. The third year we see as the final step and operation of the new facility. In the mean time, the YMCA should continue operating this during these three years. After the 3 year time frame then that would give everyone a good idea of how efficiently they are operating. The agreement should have fail safe clauses that would call for periodic reviews so that if things are not going right, they can either be corrected or a new operator will be looked into.
YMCA checked in on 2/4/04 The final survey/market analysis are back from PB&A. The CEO now has to review them and Jon Voget is putting a package together for us with all the information. He did mention that the survey was very supportive to the project and showed a very strong market potential if the fee structure stays with in the range of the existing rates.
The City of Newport Beach Marie Knight has checked in as well with the questions for their survey that will begin in Feb. sometime…we hope….. 3 Report on Fire Station - Dave Kiff (4 minutes) Steadfast is in a bidding war with the City on the Davis Property. The Davis Family has asked the City and Steadfast for their last best and final offer. The City has made that offer and the family has not responded yet. They anticipate an answer in the next 10 days.
4. Report on Old Kline Drive - Harold K. (5 minutes This project is no where. There has to be 100% compliance and there isn't. So the project is stalled. Davis and Harold are frustrated in the process. They have talked with neighbors and one neighbor is not willing to do anything for the project. Dave Kiff says that when the City takes over they will push to get Old Kline Drive improvements. He strongly stresses that they should do as much as they can now before the City takes over.
5. Report on Budget & Projects - Barbara V. (10 minutes) Agenda topics that were addressed at the January 12 th meeting of the Budget and Project Subcommittee: In attendance were: Supervisor Silva, Michelle Grettenberg, Paul Lanning, Davis Stieve, Greg Carroll, Barbara Venezia *Code Enforcement 1/ code enforcement for the West Side of SAH.
(Dave Kiff response) - I suggested to Barbara and to the PAC that, if the County was interested in throwing a few dollars our way and contracting with us to code enforce West SAH, we might be able to do it - maybe ˝ a position?
(Committee meeting response) Supervisor Silva said that he brought this issue to the Board of Supervisors at the end of last year and there is now a Code Enforcement Status Report that we have a copy of. The Board put a 90-day moratorium on the issue and now it will go before them on January 27th. The report basically said that the staff is inadequate in numbers and the caseload is about a year behind. Supervisor Silva is going to ask for more funding for this program and to get more aggressive to save these neighborhoods that are affected by lack of enforcement. Saving them from eventually becoming slums. He was successful in Huntington Beach by stressing code enforcement and saving neighborhoods. He now wants to do this Countywide.
Update 2/4/04 Supervisor Silva along w/ the CEO Jim Ruth, Planning Director Bryan Speegle and HR Director Jan Walden have initiated a Classification Study. The Classification Study will be looking at restructuring the Code Enforcement to keep up current with workloads. As we speak current C.E. Officers (w/ the exception of 1 planner) are all Building Inspectors. However, Building Inspectors come at a much higher rate. Supervisor Silva is interested in creating an entirely new Code Enforcement classification that would allow the County to afford additional classified Code Enforcement Officers.
We talked about the City of Newport Beach's offer to partner on Code Enforcement for the West Side; the Supervisor wants us to wait. Paul Lanning does not feel RA funds can be used for this. This will be re visited at the next meeting in March of the Budget committee.
*2/ Bristol Street Sidewalk & Bristol Slope issues
PAC does not feel that money should come out of our budget for this. This is a Caltrans issue and they are the ones who will have liability if someone gets hurt on this strip of property. SAH PAC wants Caltrans to cooperatively work with the County to improve the slope to avoid erosion and to improve its aesthetics.
(Dave Kiff response - Gary Adams said he had talked with the District 12 Director, as did our Public Works Director, Steve Badum. They didn't report any movement except to say that times are tight at Caltrans. (Committee meeting response). Paul Lanning said that the property in question is still owned by Caltrans and was suppose to be transferred to County jurisdiction and talks began last year about that. So far no transfer has happened.
*5/ Newport Beach take over of the redevelopment agency.
(Dave Kiff response) -Bill M was good enough to offer us some concepts that would be involved in any transfer and we (City-County) haven't met yet to talk about it. Might be within the context of the Sphere Issues Committee. No timeline.
Re: West SAH, the pre-zone the area was approved by the City Council. By mid-Feb we hope to have our Reso of Application to Council that would delineate the boundaries. So far, our pre-zoning includes all of "Area 7" - including SA Country Club, West SAH, and area South of Mesa. Costa Mesa has nicely told us that they won't let the SACC or South of Mesa go.
(Committee meeting response) The committee wants the City of Newport Beach to stay focused on the issue of annexation of the West Side residents. We have no opinion on the Country Club or the South of Mesa. We are not interested in whether or not they get annexed. Those should NOT be deal breakers for annexation. The Supervisor agrees. We need to streamline the operation of the RA and the PAC and dealing with the City and the County on the issues and projects pending needs to be made simpler, and will by annexation of the West Side. The Supervisor was very clear to us that the City wanting to take over or share the operation of JWA is mudding the waters as well. There doesn't seem to be any option for them to do that on a County wide level. There is GREAT opposition to that and will never pass Board approval. We do not want this issue to slow us down as well.
6/ Park Improvements on Orchard At our last meeting we agreed to separate this two part project: trail expansion and park equipment. The Villaraigosa-Keely Act is a law whereby playground equipment is Being upgraded/replaced through funds generated by the 2000 Parks Bond Act. Can funds to improve the park on Orchard Drive could come from this fund and not PAC moneys?
(Committee meeting response) Paul Lanning will look into the act we mention above. He was not familiar with it. Paul said that the County engineers are already planning the equipment replacement and that could take place with in the next three months. Davis said that some moms in the neighborhood expressed interest in giving their opinions as to what equipment should go into the park since their children use the park. Paul asked Davis to put a meeting together.
7/Water systems on Riverside Drive Project Paul Lanning has talked with IRWD and they are not ready to move forward on this project just yet, however they did agree to accept the original amount of money we had budgeted for this project many years ago. Paul feels that the talks between the County and IRWD will proceed this year as they need to re-examine the original agreement that was made so long ago. No action will be taken on this issue for about a year at this point. Should this be moved to a B list project? PAC needs to determine that. The PAC agrees that we leave this as A list project. Roger Summers will contact Dave Kiff and Paul Lanning and go over the orginal IRWD agreement as he has that paperwork.
8/ Horse Arena See if Paul Lanning or Chris Dargan have made any progress regarding putting the SAH Horse Arena within HBP's overall liability policy for the regional park system. What discussions have taken place with the City of Newport to begin this project?
(Dave Kiff response) -- No update from me here, except to say that I'm even more leery of a horse arena that close to the Santa Ana Delhi Channel (for water quality reasons). My guess is that the Regional Board (and maybe me in my WQ capacity at the City) will want the area built with adequate WQ protections, which would increase its costs. Not prohibitively, but it would be more expensive. (Committee meeting response) Paul Lanning did look into the insurance issue with HBP and they are not interested in property that is less than 85 acres. He did say that he was trying to find some extra funding to perhaps fund the insurance and then HBP would take it. But there are now bigger issues as the walls on the Delhi Channel are looking poorly and in need of repair as well as the water quality issue. We do not see this issue clearing itself soon.
9/ DG on horse trail Dave Kiff was suppose to talk with Jeff Dickman on getting more DG delivered to the horse trails.
(Dave Kiff response) Jeff gave me some good quotes and sources on DG. Cost is estimated 300 - $400 per tractor and trailer load. Dave says the City will pay for this and will do it this month.
11/ A look at the RA budget for 2004. Is that ready yet? How much money is currently in the fund? What amount is the State going to take from it this round?
(Committee meeting response) The New budget should be ready by our April meeting. It looks like the state will take another estimated $690,000.00 from us again to balance the deficit in Sacramento. The acoustical program is coming to an end and there is an estimated 1 million dollars that should come back into the RA fund. Paul will check on this and give us an update.
10/ Web Site news Our web site is having it's 3rd birthday. The site averages about 1223 hits a month and that number has been steadily growing as more folks in the community discover it. It has been a great resource for getting information out there about the issues we are all facing. The cost of the site is $239.40 for the year. I have already paid for the site. If everyone chips in $22.00 we have it covered. Thank you for your support on this independent site.
New projects suggestion from our website. I would like to see signs posted with speed limit, and signs to caution drivers to slow down when going up the hill at the corner of Irvine Ave. and Mesa Drive going toward Santa Ana Ave. Cars frequently are flying up the hill, to gain momentum I suppose, but there is a blind spot at the top of the hill, where the driveway of the Newport Bay Terrace Apartments is. It can be difficult to exit the complex with blind spots on both sides of the road when leaving the apartment complex. Maybe putting some small speed bumps, or "dots" on the road can alert drivers to pedestrians or cars trying to enter or leave the complex. Thank You. Pamela Chavez

6.Report on Code Enforcement Issues - Barbara V. (Eastside) & Dave S. (Westside) (10 minutes) BV: East Side January 15th Greg Carroll & Charles Spence (Cass), and I toured the neighborhood. There is a marked improvement in the whole area. The main issue we zeroed in on was the side walk along Zenith. Cass did lots of research on the strip and determined that it was the responsibility of the office building there to maintain the trees and shrubs on that land. He then contacted the building mgt. who referred him to the property management Co. The property Mgt. said that they had no idea they were suppose to maintain that property. We met with the gal in charge and she was very nice about it and very apologetic. They have since pulled out all the old dead trees and shrubs, worked with Code Enforcement officer Cass on selecting the right trees and greenery for the area and those have now been planted. The building will continue to maintain the area and there should be no more problems on that site. Job well done.
The 2nd issue we need to raise is street sweeping days. We currently have one day on Thurs. and no parking anywhere before noon on that day. Some folks are parking on their lawns to come into compliance. That is against the code enforcement rules. There is also lots of remodeling and construction going on in the area and those work men have no where to park on Thurs. What we propose is two days of street sweeping and alternate side of the street parking.
We need a motion from PAC to support this and send this to the City Manager.
Mary Slouka made a motion that we should have alternate side of the street sweeping. Richard 2nds it. Motion passes. Roger will write a letter to Dave Kiff regarding this issue since he sits on the City traffic committee.

Dear Mr. Kiff:
I am writing at the request of the Santa Ana Heights Project Advisory Committee (PAC) to request that the City of Newport Beach, through its Traffic Advisory Committee, consider an adjustment to the street sweeping schedule now in place in East Santa Ana Heights.
First, let me express our appreciation for the weekly street sweeping that we have never before enjoyed. The adjustment which PAC is requesting comes from the numerous concerns and comments from our residents because of same-day sweeping throughout the entire area, causing residents, visitors and workmen to have nowhere to park on that day of the four-hour "no parking" on streets.
We would like to request, as similar to other areas of Newport Beach, to have alternate days where street sweeping would take place on one side of the street one day and the other side of the street another day.
This would be very well received by everyone involved and we are asking you, as a member of the traffic committee, to bring this up for their consideration.

Code Enforcement for West Side: March 4th Dave and Supervisor Silva will ride along in the area and Old Kline Drive. The Sheriff is getting active in the area so that is a good thing.
7.Report from Development Committee - 20122 Cypress / Jones Residence Rick D. (5 minutes) The City of Newport looked at this case for the detached house and did not want to approve the plans as they are. The City asked the County and the County wants everything that is new being built to comply with the City codes. The Jones's will have to go back to the drawing board on this.
