Santa Ana Project Advisory Committee Meeting
February 5, 2002

Meeting called to order by Chairman, Roger Summers at 6:35 p.m.

Members Present: Barbara Venezia, Mary Slouka, Roger Summers, Richard Moriarty
Gregory Carroll, Richard Dayton, Davis Stieve, Gary Hall, Peter Macdonald, Jeff Hamilton, John McGregor

Motion: Barbara Venezia motioned to approve Minutes with one correction Seconded: Greg Carroll Carried

Introduction of Guests: Larry Serafini, Dep. Airport Director in Charge of Facilities Michelle Escoto - Representing Supervisor Silva, 2nd District

I. Remarks - Roger Summers
A. Received letter from Ann Watt thanking PAC for the new stop signs and other improvements in the Santa Ana Heights area.

II. Public Comments
A. Jay Taylor - Speaking for Ed Hall. He wants to know if there are answers to his letter of last meeting.
B. Robert Hanley - Is PAC going to take action regarding the Airport Settlement Issue? Initiative W - Is PAC going to comment on this?
C. Derek Leason - Wants to know how the $26 million in the budget has been used. During the last 20 years little has been done. Are funds being used for Kline Drive, undergrounding utilities, equestrian center, cleaning up of Bristol Street? He wants newsletter to state the amount of money and how it is used.
D. Russel Niewiarowski: Wants to know status of II-D in December 4th Minutes.
Wants to know how to report and get action on Code Enforcement issues. Each agency has a different idea. Wants to work on what the Code says to help enforce CC&Rs.

III. Guest Presentations - Richard Taylor, Airport Working Group
A. Speaking as a citizen, Newport Beach barely passed Measure F
B. Group started in 1983 as a non-profit corporation
C. County passed in 1984 an unrestrained expansion of airport. County filed federal lawsuit. Measure A/Passed- rezoned El Toro to airport; Measure S/Passed - subterfuge; Measure F- safe, healthy community including airport. Superior Court overturned Measure F as unconstitutional.
D. Measure W - seeks to rezone El Toro's land away from airport zoning. If this happens, John Wayne will expand, County will have no alternative but to expand airport. Fund raising is the key to getting the information out on what Measure W means.
E. Charles Griffen - Handed out info sheet and gave comments against Measure W

IV. Statement by John McGregor
A. Attendance at PAC Meetings - As a fireman, John's work schedule has been impacted by September 11 issues. His absences have been excused and he checks with Roger Summers and Davis Stieve after each PAC meeting.
B. The issues that concern the Santa Ana Heights community are also his issues and concerns.
C. A member of the community has broken into his house, tried to assault his wife and had his wife, child and grandchild almost run over by a car.
D. Vector Control, Code Enforcement and numerous agencies have visited his home and property and have given him a "clean bill of health" and cleared him of all concerns and issues.
E. Apologizes to PAC for all of the inconvenience by having to listen to one individual's complaints about him meeting after meeting.

V. Staff and Committee Reports
A. Community Center - Barbara Venezia
1. Holly Jarvis - The appraiser was out last week and a plan has been submitted to split off one section. Supervisor Silva's office wants a letter from PAC supporting the project.
2. Motion - Barbara Venezia motions that Roger Summers writes a letter to Supervisor Silva supporting PAC's wishes to pursue possible purchase of Koll property. Seconded by Richard Moriarty. Carried.

B. Annexation - Roger Summers
1. Sometime in March Monte Vista School or another site might be used for a workshop. LAFCO has received applications from the City of Costa Mesa, Santa Ana Country Club, West Santa Ana Heights, City of Newport Beach. Commission will rule in May. Emerson Street has also filed an application to become part of the City of Newport Beach.
2. Jay Taylor thinks West Santa Ana Heights might miss the boat in this process. Jay will volunteer to do the annexation application for all of Santa Ana Heights. Does PAC have the power to fund this? West Santa Ana Heights has an application for change of "sphere of influence" to Newport Beach. The cost of this would be about $6,000.00 Paul Lanning would need to find the answer as to whether PAC has the power to fund this. Motion by Rick Dayton for PAC to fund Jay's efforts toward funding a united Santa Ana Heights annexation into Newport Beach, not to exceed $6,000.00. Seconded: Barbara Venezia, Carried: one no vote
3. Russell Niewiarowski - suggests forming a community action group to look out for the Santa Ana Heights interests regarding the Orange County airport. Wants this group to have its own lawyers and be independent in regard to the airport issues and other Santa Ana Heights issues.

C. Cypress/Mesa Undergrounding - Mark Esslinger
1. Agenda Item Transmittal - request Board of Supervisors to approve of the idea of undergrounding utilities on Mesa/Cypress, plus assistance to funding to residents. The CEO and Asst. CEO decide the agenda items. PAC wanted to know how to assure the Underground Item would get on the agenda. Answer: There is no way.

D. Report on Trail/Arena - Barbara Venezia
1. Met with Dave Niederhaus and Dave Kiff. They would like PAC to allocate money and Newport Beach will build the trail and arena. How will it be maintained? How will Santa Ana Heights pay for this? One way would be to license the horses - maybe $100.00 annually. Part of this would be a boarding inspection to assure the horses are cared for properly. Horses would be inspected annually.
2. Motion by Richard Moriarty - Use Redevelopment money to build remainder of horse trail. Seconded: Peter Macdonald; Carried. Barbara Venezia to expedite Newport Beach to build the trail.
3. Motion by Jeff Hamilton to find availability of inmate crews to maintain trails. Seconded: Richard Moriarty; Carried.

E. Mesa Drive/Birch Street Name Change - Micki Harris
1. Still trying to get a response from Dave Kiff of Newport Beach.
F. John Wayne Airport - Ann McCarley
1. Last chance to sign up for sound attenuation program
2. Roger Summers comments that Business Park area would not qualify for insulation, but asked if apartment complex would qualify even though it is in the BP District.
3. County should be getting $7 million back from airport sound attinuation program soon.
4. Will hold $900,000.00 for 68 units and $2.8 million for possible insulation of apartments. Part of that money would not have matching FAA funds. The County would have to bear the entire cost.
5. Ann McCarley - Still don't have land from Cal Trans to make the improvements on the slope along Bristol.

G. Code Enforcement - Allan Metz
1. Can't enter without owner's permission on private property.
2. Check on property on Cypress regarding an illegal boarding stable.
3. House diagonally across from Barbara Venezia that was a mess was cited and owner is improving it.

VI. Old Business
A. Budget Committee - Peter Macdonald, Gary Hall, Paul Lanning
1. Will start process of Budget Process for 2002/2003
2. Will meet in March or April

B. Report on Draft EIR Letter - Gregory Carroll
1. Feb. 26 Greg sees Board of Supervisors certifying this.
2. Greg sees a darker side to approving the EIR, but no way of stopping the certification.
3. Every section is flawed and mechanism flawed upon close examination.
4. Implementation of the EIR would be very difficult.

C. Miscellaneous- Comment by Barbara Venezia regarding John McGregor's statement at beginning of meeting. She feels PAC members should have had the opportunity to comment on his statement regarding his absences and problems with his neighbor. Chairman, Roger Summers, disagreed and felt it was a statement without necessity of comment. Other members of PAC agreed and asked for meeting to be adjourned.
