Dear Neighbors and Friends of Santa Ana Heights - I hope that you have enjoyed the holiday season and that you are off to a great 2010 start! We have worked together and realized some significant improvements to our community. We dedicated the Mesa Birch Park and launched undergrounding utility efforts on Cypress and Mesa Dr. These projects significantly improve neighborhood aesthetics, safety and utility infrastructure- which make SAH better for residence & provide a value “boost” to our properties. 2010 also brings the proposed sunsetting of the “Santa Ana Heights Project Advisory Committee” (SAHPAC). As Project Advisory Committee Chairman, it has been my pleasure working with the members of the committee and community residence. I appreciate your sense of “community” and your commitment to making our neighborhood a better place by attending PAC meetings. This has been an effective “forum” to share ideas, opinions and leverage the diversity of thought to drive committee action. I would like to this opportunity to thank all past committee members and the current seated committee: Rick Dayton Mary Slouka Gary Hall Richard Moriarty Gary Golson Jayne Jones It has been my distinct pleasure to work with each of you. The community has benefited from your passion, tenacity and dedication. With the anticipation of the sunset of the committee, I have asked former Chairperson’s Roger Summers and Barbara Venezia to give their opinion on the importance of the PAC and how it changed our community. Here are their comments.
Dear Community: My fondest memory of my association with PAC was meeting the people who make-up our community and getting to know them and their personalities and concerns. I think we all would have like to have seen more of our “pet” projects happen but looking back those that did have certainly been an enhancement to our area. Thank you for allowing me to serve you and I have no regrets. I wish everyone the best now and in the future.

It was an honor and a privilege to be part of PAC. As I look down Mesa and Cypress St. today, and as the undergrounding project moves forward, I can't help but think back on the first day George Britton and I stood on the trail talking about the possibilities back in 1993. It’s poetic justice that this is project that's completing as PAC sunsets.
Present and past PAC members have shown unrelenting dedication and perseverance in the face of bureaucracy. We should all take pride in the Santa Ana Hts. Fire Station, Mesa Birch Park, and a sidewalk on Bristol St. The annexation of both East and West Santa Ana Hts. was by far the hardest fought of all our projects and in the end, we were successful.
We can't look back with regret over the ones who got away, the Horse Arena, Kline Dr roadway improvement and the Community Center. Each had issues far beyond the control of PAC. PAC Members should take pride in the fact they did all they could.
In the end, as PAC goes away, Santa Ana Hts. continues to flourish and be home to many new families who are all better off because of PAC's efforts. Lots of Smiles BV
In closing, I would like to thank each of you in the SAH community (almost 900 homes) for helping us grow into this unique Newport Beach neighborhood. ,A tremendous “thank you” to John and Mario of the 2nd District OC Supervisors Office for their stewardship in getting the voice of the PAC heard in the greater community. Additionally, Dave Kiff, Newport Beach City Manager, has been a significant factor in our successes. Thank you, Dave, for your leadership with respect to helping our community develop and grow. Lastly, thanks to my daughter, Morgan, who is my personal source of inspiration. Morgan never hesitated to share her unique perspective or get involved with the work associated with making our community a better place to live. You many not have heard but, Morgan was a catalyst for the Mesa Birch Park and the strong voice for the completion of the trail system. We are grateful to now have both in our community. What’s next for me? I’ll be working the “no JWA expansion” initiatives. And, lastly, like you, I’ll continue my personal efforts to be a good neighbor and to make a positive difference in our community.

Kline Drive - Dave Marshall- County’s project manager for the Kline Drive project. /Bob Stein City NPB Right of way has been dedicated by 6 of the 9 property owners. As discussed in our last update sent to the property owners, we are still lacking the necessary right of way dedication from 3 of the owners. Although we’ve made substantial progress with one owner, the remaining 2 owners have presented unique challenges. Although all these owners have indicated support for the project, we can’t move the project forward without the executed deeds and other right of way documents. The County, with the assistance of our planning consultant Rosenow Spevacek Group, Inc. (RSG), is making every effort to secure the necessary right of way.

The Curfew:
In 1985, the City, County, SPON, and AWG entered into a stipulation and agreement (1985 Settlement Agreement) to resolve Federal Court litigation initiated by the County seeking judicial approval of the Master Plan. The 1985 Settlement Agreement required the Board to modify resolutions approving the Master Plan to reduce the size of the terminal and limit the number of parking spaces. The 1985 Settlement Agreement also: (a) established three "classes" of commercial aircraft (Class A, AA, and E) based on the noise generated by the aircraft (operating with known gross takeoff weights) at the departure noise monitoring stations. (b) limited the number of "average daily departures" (ADD) of Class A and AA departures before and after construction of a new terminal to 73 ADD (c) limited the number of passengers served each year at JWA (expressed in terms of "million annual passengers" or "MAP") to 8.4 MAP2 after construction of the new terminal and (d) required the County to maintain the curfew then in effect at JWA and enforce the General Aviation Noise Ordinance.
In 1990, Congress adopted the Airport Noise and Capacity Act (ANCA) which, in relevant part, requires FAA "review and approval of proposed noise or access restrictions" on Stage 3 aircraft. The City and County successfully lobbied Congress to "grandfather" (exempt from the FAA"review and approval" requirements of ANCA): (a) the 1985 Settlement Agreement; (b) amendments to the 1985 Settlement Agreement that do not adversely impact airport capacity or airport safety; and (c) the then current County noise "curfew" ordinance.
The 2002 Amendments allowed the County to offer additional air transportation service without any significant increase in noise impacts on Newport Beach residents. The flight and service level restrictions remain in effect through December 31, 2015 and provisions related to the curfew remain in effect through December 1, 2020. The FAA letter confirming the validity of the 2002 Amendments is a precedent for future amendments that do not adversely impact airport capacity or airport safety.
The GANO (General Aviation Noise Ordinance , also implements curfews and scheduled departure time prohibitions for commercial operations. The ordinance states that no commercial aircraft may engage in regularly scheduled commercial operations at SNA between the hours of 10:00 p.m. and 7:00 a.m. (8:00 a.m. on Sundays) for departures or between the hours of 11:00 p.m. and 7:00 a.m. (8:00 a.m. on Sundays) for arrivals. Commercial airlines are prohibited to schedule departure times for any flight originating at SNA prior to 6:45 a.m. or after 9:45 p.m. Monday through Saturday; or before 7:45 a.m. or after 9:45 p.m. on Sunday.

The GANO establishes curfews for GA operations as it does for commercial operations. The ordinance states that no GA aircraft may engage in nighttime operations that exceed the SENEL values specified in Table 2-6 at any of the ten respective noise monitoring stations. Nighttime operations, for the purposes of this section of the GANO, are considered to be between the hours of 10:00 p.m. and 7:00 a.m. (8:00 a.m. on Sundays) for departures and between the hours of 11:00 p.m. and 7:00 a.m. (8:00 a.m. on Sundays) for arrivals.
