Minutes - Santa Ana Project Advisory Committee Meeting- December 4, 2001

Meeting called to order by Chairman, Roger C. Summers, 6:30 p.m.

Members Present: Peter Macdonald, Robert Banghart, Roger Summers, Rick Dayton, Greg Carroll, Richard Moriarty, Barbara Venezia, Mary Slouka.
Members Absent: Davis Stieve and John McGregor asked to be excused

Guests: Jim Clark, Deputy Assigned to Neighborhood, Sheriff's Office Enhancement Team - Quality of Life issues. Noise - has been in effect for a year now. They will be attending PAC Meetings.

I. Motion made by Barbara Venezia to approve Minutes. Seconded by Greg Carroll. Motion carried.

II. Old Business - Dave Kiff, City of Newport Beach
A. Annexation Issue. City has three issues
1. Newport Coast Community's citizens tried to get injunction to stop annexation. It was turned down.

2. Costa Mesa has completed their application with LAFCO. Will set community LAFCO workshops/meetings, then meet with LAFCO by February or March. Annexation could happen quickly after that. Protest period will have 30 days after LAFCO action.

3. How does Greenlight apply to new annexation area in regard to Specific Plan? Answer: Would only come into play if someone wanted to amend Specific Plan

4. LAFCO Workshops will be held before any staff report is written regarding annexation issues.

5. Re: Bay Knolls Area. It will remain in the cities where they now have their postal addresses reflecting the current City's "sphere of influence"

6. Representative from West Santa Ana Heights wants to know why Bay Knolls was released from Costa Mesa, while West Santa Ana Heights was not released. Nothing in all of LAFCO's papers explains why this happened.

7. Representative from West Santa Ana Heights said area 7, including West Santa Ana Heights, Santa Ana Country Club, and small area by Mesa Drive will be protesting annexation to Costa Mesa. Will Newport Beach step up to annexation if Costa Mesa loses the fight to annex?
Answer: Dave Kiff doesn't have direction from the City of Newport Beach City Council, so cannot answer either way. Suggests a letter be written to new mayor regarding this issue and put it on the City Council agenda.

8. Russel Niewarski, rep. From West Santa Ana Heights says Newport Beach
should get West Santa Ana Heights to prevent plans F&G from happening. Area 7 could be split up if not annexed in total by Costa Mesa.

B. Jay Taylor - submitted letter from Ed Hall and items for discussion.

C. Rita Lorman - read a letter regarding annexation of Santa Ana Heights. Submitted letter to be included in Minutes.

D. Russell Niewarski - Happy about trails being planned for and wants to help plan and build them. Wants the resignation of PAC member John MacGregor based on his property and how it is maintained.

III. Staff Reports
A. First Draft of AIT done. It will be forwarded to County, Ex. Office, then go on to Board of Supervisors.

B. Barbara Venezia - Undergrounding does not cover individual hook-ups. Could be paid for by:
1. Lien on Property
2. Tax on Property
3. Paid for Directly by Property Owner

C. Holly Jarvis has another payment option. Private loans could be obtained. $2,000.00 loan at 8%/month would be approximately $19.00/mo. This price is over a 5-year payment plan. Homeowners could also do a second trust deed.

D. Upper Newport Bay Equestrian Issues - Mark Esslinger
1. Nov.1, Richard Moriarty and Carla Brockman's lawyer met re sewer lines and road proposed. It is going well on negotiations.

2. Equestrian still has access to trails. Maybe license fees could be levied on horse owners. County does have complaints on horse trailers and jumps being used and put in the public arena areas by Delhi Channel.

3. Flood Control approved building arenas in Back Bay where PAC had wanted them

4. Dr. Nguyen will be cited for driveway over bridle trail on Cypress. First fine is $100.00.

5. Improvements of bridle trail by Carla Brockman's property will be done within a month/weather permitting.

6. Drain system has been improved with DG and is more compact and safer.

7. Jeff Dickman wants date for arena's completion. There is no completion date at this time..

E. Mesa/Birch Name Change - Micki is trying to get City of Newport Beach to approve it so it can be done.

F. Report from JWA - Ann McCarley
1. Bristol Street slope improvement. Nothing has been done since September 11th. Airport is concerned with security, financial issues and needs to own the land before anything can proceed further.

2. Has EIR Impact Report. Will give it to anyone that asks.

3. National Guard is working in airport and people are beginning to start flying again.

4. Delta's MD 90's have been blowing out tires, 12 times since 1998.

5. Greg Carroll and Peter Macdonald will look at the EIR Impact Report and report back to PAC so it can send a letter regarding its standing on Airport Expansion issues.

G. Code Enforcement
1. The house on Cypress with vehicles and overgrown weeds has been cited.
2. The house on Bristol owned by Leah Long with the illegal sign business will be cleaned up by December 15th.
3. Property on Birch & Orchard - needs to get rid of farm animals - roosters are illegal plus others illegal if recently placed on BP property.
4. 20304 Cypress - Barbara Venezia called on this property for illegal boarding of horses. Asked Code Enforcement to look into complaint.
5. Birch Street is now BP - Roger Summers understands if you have had horses you can keep them. If you didn't have horses, you cannot bring them in. Does this include other animals, ie ducks, goats, chickens, cows, etc.?

IV. Old Business

A. Annexation - already done. Taken out of order earlier in meeting.

B. Proposed Project Survey Report - Handout of results.

1. Barbara Venezia and Holly proposed use of Koll Property for Santa Ana Heights Community Center.

2. Barbara Venezia motions to ask Mark Esslinger to look into using Redevelopment money to purchase Koll property as Community Center for Santa Ana Heights and how it would be owned and operated. Seconded by Mary Slouka. Carried 10-0.

3. Sub-Committee - Barbara Venezia, Mary Slouka, Jeff Hamilton, Greg Carroll to see property 10:00 a.m. Monday, December 10th.

C. Report Development Fee - Micki Harris
1. To establish these fees is a long, complex process. Maybe some other way would be less expensive and time consuming.

2. Birch Street Plaza Office Project - Micki Harris

a. This is the old Saywitz Project

b. Was piece of land owned by County revalued re: its purchase price? No answer available.

V. New Business
A. Project proposed at 2172 S. Bristol Street -
1. New vacant lot for storing of rental cars and has a sign put on it. It was a former dog kennel.

2. Derek Leason objects to the project because it doesn't think it fits with the neighborhood, and doesn't want shuttle services going through the Santa Ana Heights neighborhood. Explanation - It would only be for clients of Fletcher Jones and traffic would be minimal.

3. Project approved by PAC 10-0.

4. PAC Dist. Development
a. Keith Bohr, rep. For Leah Long 2302 and 2323 Bristol Street

b. Dev. can only happen if all 5 lots are developed together. County has 3. Mrs. Long has 2 lots. They are now interested in a joint venture between Mrs. Long and Keith Bohr.

c. PAC is interested in pursuing this type of development.

d. City of Newport Beach would need to find a permanent home for Fire Department .
e. Gary Hall - Motion - PAC in favor of lot consolidation for Project Development. Seconded - Richard Moriarty. Carried 9-1-0

5. PAC Website and Newsletter - Barbara Venezia
a. Proposes website include phone numbers, pending issues, newsletter, email addresses, minutes from last meeting and agenda. $35.00 for name for year plus $25.00/month. Barbara will sponsor website.

b. Barbara worked long hours with County to compose information on newsletter. Nothing got into newsletter about concerns the general public has.

c. Roger wants to know if website address can be put in newsletter.

6. Greg Carroll says a 2nd sweep date has been added. There is now a grace period of 2 months because notification wasn't given properly. Anyone with ticket for 2nd sweep day will not have to pay ticket.
