Introduction: 5 minutes 1.Approval of Minutes: Mary Slouka made motion to approve the minutes. Richard Moriarity 2nd Motion passed. 2. Introduction of Guests: Dave Kiff Asst. City Mgr. NB, Dr. Honey Thames - Yellowstone Recovery Homes, Jason Vasquez John Wayne Airport 3. Chairman's Remarks: Roger wanted to take this opportunity at the end of the year to remind everyone what PAC is all about. The main purpose, to advise. We are an advisory committee to the Board of Supervisors and also to the City of Newport Beach. We can't make any binding decisions, only submitting recommendations to both agencies. We have been in existence since 1982. We are not a policing agency and are not a homeowners association. Our primary responsibility to make suggestions on projects to the City and BOS, and monitoring those projects as they move forward. We also follow and make sure the Specific Plan is implemented.
Public Comments (Non-Agenda Items): Limited to 3 minutes each 1/ Rita Lorman: In the newsletter it said that 3 new flights are being added to JWA. Are any flights being deleted? What happened to McGregor on PAC.
2/ Bob Hanley: He sees that we have allotted 15 minutes to Yellowstone, what happened to the 3-minute rule. (Roger answered that we have allotted a total of 15 minutes to the subject, as it is an agenda item.) Will there be questions and answers. (Roger answered, if time allows.)
3/ Randy Ranck: Randy is complaining about the dog kennels and played a tape of what it sounds like 15 feet from the kennels. The tape was recorded at 6:00 AM. The apartments are close to the kennels and after Oct.7th meeting at County the dogs have been quieter. He also handed out information on noise levels. He has been researching this and over his vacation he logged the entire dog barking and the times in the mornings. He says the kennel owners have not come up with any solutions. (Mary asked if has called animal control. He said yes and that is just for one barking dog and not for kennels)
4/ May Ranck: The kennels she is complaining about: Sherry's Poodles and Coast Canine. Their ads say they have 24-hour service for the dogs, but May says they do not. She says that they are not caring for the animals properly. Animal control told her you can take the dogs to the Back Bay to walk them but they are not doing that. She is also complaining about the noise, care and upkeep. She has also visited County zoning and she does not feel that is being followed. The Codes say the dogs need to be inside until 7AM. That is not happening.

ISSUES PERTAINING TO SANTA ANA HEIGHTS PEGASUS TRACT:
1. Lack of representation. Who is policing (west) Santa Ana Heights? We have multiple code violations at multiple addresses which remain unresolved after numerous complaints for years.
A. We have multiple residents that continue to block the public sidewalk with their vehicles. The Sheriffıs Department will give warning but not ticket the same offenders.
B. There are many residential structures/properties that are not being maintained. Code Enforcement seems to shrug this off and use the excuse that they are understaffed.
Resolve: I request that the SAH PAC address this in a letter to Supervisor Jim Silva, Code Enforcement and to the Sheriff requesting that pro-active policing measures be implemented. I ask that the County of Orange produce and distribute a letter to all residents informing them of parking laws and property maintenance informing residents that parking tickets will be issued when cars are blocking sidewalks.
2. Zoning. RSF means Residential Single Family. Why are we allowing businesses to come into our RSF community and set up businesses that are considered an offense to the community? Businesses like rehab houses, auto repair, etc. are found in our community. According to our CC&Rıs, any business operated by a resident within RSF zoning which is considered an offense to the community is unlawful.
3. Excessive traffic noise. Bristol Street traffic, the Toll road traffic and the noise generated by the Bristol Street Auto Complex is excessive at times. Sometimes Cal Trans will be doing loud sandblasting on the Toll Road at 11:00 PM to 2 AM. The Auto Complex will generate loud noise on the evenings and weekends, many times racing and revving engines.
Resolve: I request that SAH PAC write a letter to Cal Trans and to our County Supervisors requesting sound walls on Bristol Street and the flyover Bristol Street roadway near the Pegasus tract. I also request that SAH PAC write a letter to the City of Costa Mesa City Council and to the property owner(s) of the Auto Complex requesting that they raise the height of the block wall between the complex and the residents to generate an effective sound barrier.
4. JWA. I request that SAH PAC contact the City of Newport Beach and request a community meeting to discuss the cityıs plans for controlling JWA.
Community Reports Dr. Honey Thames - Yellowstone Recovery Homes (15 minutes) They are new neighbors on the West Side. They have transformed the house on Indus in 28 days and have really improved the home. What is Yellowstone? They are a family of recovery homes and the women who live there are examples of success in recovery. It is a safe house and is anonymous. These women learn to live together again and they come from communities just like yours. They have lost their way and the women in this house have earned their way back. They live under restricted circumstances so you wont' see cars, or lots of people or noise.
They are a non-profit organization that helps women. They scholarship about 25 % of the women. ½ are "haves" and ½ are "have nots". They provide a solution to women who are changing their lives. They provide: services of recovery and a safe house for women in need.
Impact on day to day lives. They believe they are good neighbors and have a willingness to listen and blend into the community.
What impact and value is gained by having them in the community? In every community the property values have increased. There is a whole community of support for recovery. Every state and County program they have applied for, they have been approved for and got A+ ratings. Roger asked about number of people in homes. Honey said that is regulated by the Fire, County, and Housing codes depending on square footage.
Comments on Dr. Thames talk: Bob Hanley says that the house had been vacant about a year and the Brooks lived there for over 10 years and rented that house. He believes they were a ploy for the recovery home to come in.
Rita says she rode on the bus with some of the girls of Yellowstone and didn't like the way they acted.
Steven Abrahams said he has been a resident for 3-4 years and hopes the Dr. will stay more in touch with the community to promote understanding.
Russ Niewiarowski: Russ says that they are good neighbors and have done a good job fixing the house and has improved property values. He does object to the multi family use and operating businesses in the area.
Roger says that this is NOT a PAC issue, but he does hear that the Dr. is willing to learn and be a good neighbor. Roger suggests that Dave Stieve, Dr. Thames, and Steven get together and talk about the possible solutions to work together and come back to us in two months and see what solutions have come about. Roger thinks there needs to be some communication within the Pegasus area. Dec. 19th Yellowstone at 1621 Indus is having an open house and invites everyone to come.
Staff and Committee Reports:
1. Report from JWA - Jason Vasquez (5 minutes) Jason reported that no flights are being eliminated to answer Rita's question. The Bristol St. slope: Cal Trans has talked with the County and because of the budget restraints it still is not moving forward. Rick asked about monthly statistics that recently came out that says there is a decrease in operations and an increase of 14% of passengers. Commuter jets increased 40% in the last year. Charles Santos (County contact for the Bristol Street Slope) telephone number is 714-834-3614. He can answer more questions.
2. Report on Community Center - Rick D. & Barbara V. (15 minutes) 1/ Community Center: On Nov. 3rd BV, Roger Summers; Rick Dayton met with Gary Adams, Homer Bludau, Dave Kiff, Marie Knight, and Jon Voget. Homer informed us that the YMCA property purchase should be complete by end of Dec. Purchase price at 4.3 million dollars. An interim 24-month agreement to operate the facility will be given to the YMCA. A time line for the next 6 months will be coming from the city outlining the next steps and time frame from purchase up to start of building the facility.
At the meeting with Jim Silva, the next day, the subcommittee discussed the fact that in the Memorandum Agreement handed down by the Board of Supervisors, on page 3 it clearly states " The total amount that the agency shall be required to pay for the acquisition costs of the Recreational Facility Property shall not exceed the lesser of the City's acquisition costs or $4 million dollars." Paul Lanning and Supervisor Silva were not aware the City had exceeded that amount and will contact Homer regarding this.
Supervisor Silva made it clear to us today that we CAN NOT go back to the Board of Supervisors for any additional funds. I asked for further clarification on this. Michelle Grettenberg called me 12/2/03 and said that as far as the Supervisor's office and CEO's office are concerned, the City of Newport Beach can not pay more than 4 million dollars for the property. Anything over that amount must come out of the City of Newport Beach's fund. The building and improvement dollars of 7.5 million can not be used towards the purchase price according to the document of agreement.
On Nov. 18th Roger, Rick, BV and Jon Voget took a trip to the Torrance YMCA to tour that facility. This YMCA was built in the 1960's and only had work out facilities until about 2 years ago when the community was asking for more...so they added on 20,000 square feet of Community Center, upgraded their athletic facilities to better meet the members needs, and brought their facility to a total of 70,000 square feet.
In the first 10 months of finishing their renovation, their membership jumped by 1000. The facility never closed during construction and today it is used for a number of community needs. Polling place during elections Teens Community Classes Family Counseling Senior lunch program Parties of all sorts We were there mid afternoon and the place was very crowded they did a great job of integrating the two functions as we are trying to do. BV has contacted Homer, Dave and Marie Knight to tour this facility as well.
In addition, Jon Voget reported to us that the YMCA has contracted Paul Balducci with PB&A Marketing Research Company. He has been hired by the YMCA of Orange County to produce a market study, providing the data required for us all to make decisions with the confidence level we need to move forward with this community center. His study will provide Demographic/Market Potential, Program Mix and Price Sensitivity etc. (through 600 phone surveys) We are pushing to get the results back by the end of Dec. The YMCA is paying for this study to the tune of $20,000.00. We also met with the City and they will have input into the questions on the survey as well so we can all benefit from this information.
The YMCA is currently going ahead and purchasing about $60,000 worth of fitness equipment doing some painting, and replacing the pool heater at $15,000.
Jon also reports that their National office was very impressed with Rick's Plan and the opportunity to Balance our program mix with Social, Community and Fitness programming located in an unbelievable setting. He will be sending this in writing to give their blessing and support to help us thought the process. 3. Report on Fire Station - Dave Kiff (4 minutes) Dave says they are still negotiating with the property owner on Acacia and Mesa. The family was supposed to meet over Thanksgiving and talk about it. Dave is still working on this. Roger wanted to know what the time line for this would be. Dave stressed that the City is working on this diligently.
4. Report on Old Kline Drive - Davis Stieve (5 minutes) Harold has talked with all the residents on the street and all the residents are interested and handed in the survey forms. One person is still holding out and still leery. The two property owners, who do not live there, they have not been able to contact. Dave and Harold are continuing to work on this. The next step is to get everyone together and look at the County Plans. Dave and Harold will contact Mark Esslinger to get this meeting together.
5. Report on Budget & Projects - Peter Macdonald (10 minutes) Report on Budget committee meeting. 11/4/03 PAC Members: BV , Greg Caroll, Davis Stevie,
The committee met with Supervisor Silva, Michelle Grettenberg and Paul Lanning. Here are the topics and updates we covered. Next Meeting January 13th at 2:00 PM
1/ Undergrounding: Dave Kiff told me that the Undergrounding is now in the City's jurisdiction. We can expect the City Council in Jan or Feb. to form the Utilities District and hold the public hearing on the project. The next step is to get together with all the utilities and decide what and who will be involved.
2/Water System on Riverside Drive: Paul Lanning met with the IRWD Gen. Mgr. the Gen. Mgr. discussed the fact that to his knowledge there is nothing wrong with the water lines in the area. The only question was the fire flow. New hydrants have gone in on Riverside Drive and he will check and get back to Paul if the new hydrants have solved the fire flow problem. If they have, this project comes off the list and the budgeted $420,858.00 comes back into our fund. Paul will follow this up. On Dec. 2nd Paul sent an email and wrote: IRWD indicated that while they had made some improvements in the area, they were not the improvements covered by the contract with the SAH Water Company. They were going to consult with their engineering staff regarding what projects still needed to be done and what the cost would be. Looks like the money will not be available for other projects.
Dave Kiff says that he will help with this as the IRWD should be picking up the tab for these improvements, not PAC dollars.
3/ Park Improvements on Orchard Drive: This project was budgeted at $295,200.00 and that price included the proposed trail along the golf course on the West Side as well as replacing the park play equipment. The suggestion now is to split this project into two parts. The park equipment can be replaced almost immediately and that should be one project item. The trail portion should become it's own project and placed on the C Project list. We will take this to PAC in Dec. Richard makes a motion to split projects, they both become A list projects but they stand alone. Mary 2nds and this passes. Jay votes no.
4/ Old Kline Drive: This was discussed at length with the Supervisor. He is requesting more information and Davis and Michelle will get together on that. As you all know, this is a complex issue with many layers and Davis and Harold are working diligently with the landowners on this issue. We all felt that with the Supervisor's involvement maybe we can get to some resolutions.
5/ Horse Arena: Paul Lanning will contact Dave Kiff again about the liability issue in the Delhi Channel where it is slated to be built. Supervisor Silva suggested that Paul try and get some sort of time frame from the flood control folks as to when they plan to re do the channel. It might be worth building it in the channel if we had 10 years or so before they made improvements. The issue of who pays to move the arena in that case was also raised. On Nov. 6th Dave Kiff visited the neighborhood with BV and they drove down Mesa Drive to look for an alternative for the arena. They also drove down to the channel to look at the proposed site. Dave agreed that the channel site would be the best suited and could get built much sooner. He is working on the liability issue and thinks it can be resolved quickly. Dave wrote a letter to Paul asking him to write to County Council to ask if they would include this in their parks liability policy.
6/ Bristol Street Sidewalk: We asked Paul to talk with the road dept. and see if they would consider splitting the cost of the sidewalk with us. Cal trans still has not transferred the property to the County. It is still in their Jurisdiction. Paul will get back to us on this. PAC will not approve the total cost of $300,00.00.
Roger asked BV to write a letter to Gary Adams about the Cal Trans projects asking for help in addressing the Bristol Street sidewalk and slope on the airport.
Our next budget committee meeting will be in January 13th. Michelle, Paul and Supervisor Silva will be in attendance again. We hope to re-visit the above projects and check their progress. We have also asked that Ted Ragoni be present as well so we can talk more about the Bristol St. sidewalk. 6. Report on Code Enforcement Issues - Barbara V. & Davis Stieve (10 minutes) EAST SIDE REPORT On Nov. 18th Greg Carroll, BV and Charles Spence toured the East Side of Santa Ana Hts. for the 2nd time in so many months. There was a substantial difference in this tour VS our first tour.
As we drove by some of the homes that had flagrant violations last time, this trip most had been taken care of. We were happy to hear that in most cases, Charles aka Cass, was able to settle the issue by just talking with the homeowner and not having to issue a citation. There is a marked improvement in the neighborhood.
Cass is working on the office building that is on Zenith. After doing extensive research on the project, he discovered that this project was approved by the County and not the City of Newport Beach and were never in compliance with the trees and ground cover. After numerous phone calls to the owners, who basically were ignoring the issue, they have been issued a citation. They will now have to plant 36 inch pots of 10 -12 foot trees and about 40 of them. They will also have to plant ground cover. All according with the Specific Plan and Cass has outlined what they are required to plant and in what time frame. We will re visit this in January when we tour again.
The other issue is the property at New Fletcher Jones Shuttle Service Facility to JWA 2172 S. E. Bristol Street Newport Beach, CA 92660. This lot was never used for this purpose and is just overgrown and unsightly now. I sent the copy of this letter to Cass to help in his investigation

RE: New Fletcher Jones Shuttle Service Facility to JWA 2172 S. E. Bristol Street Newport Beach, CA 92660
Dear Mr. Melton:
In the review of the project at the PAC meeting on 12/4/01, there was an additional concern of the residents in Santa Ana Heights that the Fletcher Jones shuttle buses would drive through the residential neighborhood via Spruce Street to reach the airport. I spoke with David Recupero, the agent for the applicant, about this concern. Mr. Recupero did not believe that shuttle buses would choose to use the route through the residential neighborhood to reach JWA. He also indicated that the applicant would not have a problem with a condition which prohibited a shuttle route through the residential neighborhood. I wish to add the request of the PAC that there be a condition preventing the use of the residential streets of Santa Ana Heights for the operations of the Fletcher Jones Shuttle Service.

The other issue discussed on our tour were the new signs on the horse trail that remind neighbors about the Water Quality Ordinance. Section 7.20.020 Nuisances Committed by Animals.
It is unlawful for the owner or person having charge, custody or control of any animal to permit such animal to defecate and to allow the feces to thereafter remain on any public sidewalk, public beach or park or on any other public property or on any private property other than that of the owner or person who has custody or control of the animal.
B. No person having the care, custody, charge or control of any animal shall permit or allow that animal on any public sidewalk, public beach or park or on any other public property, or on any private property other than that of the owner or person who has custody or control of the animal, unless that person has, in his or her possession, an implement or device capable of removing any feces deposited by the animal.
C. The provisions of this section shall not be applicable to: 1. Any animal enrolled and participating in obedience classes offered by the Community Services Department of the City or in any show for which the City has issued a special event permit;
2. Any guide dog while being used by a blind person or any dog being trained to be a guide dog for the blind pursuant to a recognized program of training provided the dog is on a leash and the person in charge has an official identification card issued for such purposes;
3. Any blind person. (Ord. 95-45 § 1, 1995: Ord. 89-8 § 9, 1989: Ord. 1814 § 1, 1979: Ord. 1146 § 1, 1965)
This has been posted on the PAC web site since July. No one seems to have cared or paid attention until the signs went up in Nov. BV has been working with Dave Kiff coming up with ideas to help horse riders and dog owners comply with this law. She has purchased 4 small trash cans and shovels and placed them along the trail on Cypress. The plan is to get more and to get homeowners along the trail to empty the bags in the cans.
WEST SIDE REPORT: West Side Code Enforcement Report: Supervisor Silva is aware that County Code Enforcement is severely lacking in enforcement. He is bringing the issue to the Board of Supervisors and it is on the agenda for the Dec. 9th meeting. At the meeting, Supervisor Silva will request that the Board look into County Code Enforcement and find out what violations they have addressed, costs, what the back log is currently and what it will take to bring this up to speed. How many officers are needed to make this dept. more efficient will also be addressed.
Supervisor Silva believes strongly in code enforcement as a way to save neighborhoods and keep property values up. The Board will come back with recommended actions on this issue. LIGHT ON PEGASUS STREET. Jay says that the traffic light issue on the West Side Pegasus St. Jay says the burden should be put on the County to put a crosswalk and flashing lights and Jay said he would write another letter to the County regarding this issue. There is a bus stop there and that is being regularly used. Put this on the agenda for next PAC meeting.
7. Report from Development Committee - 20122 Cypress / Jones Residence Rick D. (5 minutes) Rick says that this project has some issues and they are caught between the County regulations and the City. They are trying to build a second living unit. Rick said PAC could grandfather this plan in or amend the Specific Plan. Rick made a motion not to amend the specific plan. 2nd by Gary and motion passes. We do suggest that this goes back to the County and Dave Kiff offered to help since they paid their fees to the County and started with them. Rick will get Dave a copy of the letter support from PAC back in June to help them on this issue.
