DRAFT MINUTES

August 7, 2001

Meeting called to order by Roger Summers at 6:30 p.m.

Attendance: Roger Summers, Gary Hall, John McGregor, Rick Dayton, Greg Carroll, Davis Stieve, Robert Banghart, Richard Moriarty, Barbara Venezia

Guests: Allen Metz, Code Enforcement; Paul Lanning, CEO Office; Supervisor Wilson, Holly Veale; Ann McCarly, John Wayne Airport.

First order of business was to introduce Supervisor Wilson, who presented a Proclamation to Rita Jones' family who were in attendance. Supervisor Wilson read a plaque and commented on Rita's many years of unselfish service to her community. Roger Summers said a few heartfelt words about his feelings regarding Rita and her years of community involvement

Supervisor Wilson said that with the new redistricting we would no longer fall in his jurisdiction. He wasn't sure when the change would occur, but he would keep us posted. He felt this would be his last attendance at a PAC meeting.

Roger Summers commented on the Fire Station Open House on July 21st and how well it was attended by the community. He expressed his appreciation to the Fire Department for holding the open house. Roger also welcomed Barbara Venezia as a new PAC member.

I. Public Comments.
A. Roger Summers - had two phone called from folks who live on the Bristol side of Mesa concerned about the brush and fire hazard in from the estates which is part of the ecological reserve. They need to talk to the Parks Department and Weed Abatement. John MacGregor gave us the phone number to pass on - 714-744-0400.

B. Russell Niewarski - reported that his airport group has retained a land use attorney and their comprehensive reasonable airport initiative plans would be going on a ballot in an upcoming election. He gave out a plan map. He complained that he lived next to a PAC member who was not in compliance with Code Enforcement regarding parking vehicles and weed abatement.

C. Lisa Clemons - reported on her ongoing efforts to resolve the problem of the driveway and trail at 20391, the Nguyen's property. She has been in touch with all the right departments and still is not getting any results. The offending party has been given notice and fined by the County and has still not complied or responded. Lisa is now working with Jeff Dickman at the County. This violation is a danger to the horseriding community. Barbara Venezia and Micki Harris will get involved with Lisa and try to get a resolution by the next PAC meeting.

D. Theresa, Cypress Street - complained about horse droppings and messy trails. Rich Clark said they have now hired a person to clean the trails twice a week.

E. Jay Taylor - commented on Ed Hall's behalf about a gas line on Santa Ana Avenue that he felt was unsafe. Roger Summers will get in touch with Ed and go look at the problem in person to make an evaluation.

F. Derek Lessen, Cypress Street - commented that he has been working on the extension of the JWA settlement agreement and was passing around a letter for neighbors to sign. Derek also suggested that there be a Horse Committee containing horse and non-horse folks to hash out solutions to complaints. He commented that there were many sign violations on Bristol Street.

G. Rick Dayton - commented that there is a Horse Committee, the Back Bay Equestrians. Roger asked that it be put on the Agenda for the next meeting so they can address these issues.


II. Cypress Street Undergrounding Report

A. Mark Esslinger reported that there were 26 yes and 22 no votes out of 107 mailings. The last newsletter reminded folks about the vote and he will send another letter to non-responsive addresses in September after the holiday weekend. Much discussion over the language of the letter and what the County allowed and past history of community responses. Barbara Venezia produced the original County documents outlining the options to pay for undergrounding. The audience called for PAC to take a stand and vote on this issue.

B. Gary Hall made a motion that the PAC send a letter to the Board of Supervisors recommending that they move ahead with the undergrounding. Richard Moriarty seconded the motion and it carried, 6 for and 3 against. Roger Summers said he would send such a letter to Supervisor Wilson. He stated before the vote that he was not in favor of this project without a dollar value and was met with resistance and open animosity from the audience. The letter would be cc'd to Paul Lanning and Dr. Schumacher.


III. Report on Equestrian Arena
A. Mark Esslinger reported that the application has been approved by the Coastal Commission to build on the site. This will be a joint effort on behalf of OC Development Agency and Harbors, Beaches and Parks. City of Newport Beach reviewed the report. The next step is to get RFQ to design the facility. Roger asked if they could design while waiting for approval. Mark said the process was to wait for total approval from all agencies involved and then move ahead with the design.


IV. Mesa/Birch Name Change
A. Micki Harris reported that the official name change has been filed and there was one resident, Mary Davis, who wished to change her address to Acacia. Richard Moriarty made a motion to approve, Gary Hall seconded the motion, and it passed unanimously.

V. John Wayne Airport Report
A. Ann McCarly reported that the Board of Supervisors had approved money for the Bristol Street Slope Project re-design and by the next PAC meeting, the changes will be brought to PAC. They are working with Rick Dayton on this

B. There are still 67 homes that are eligible for the acoustical insulation program. 80% of the homes have been insulated. A letter will be sent to homeowners who have not yet joined the program, stating that the program will be coming to a close, but they still have time to take advantage of it.

C. Fire Station #33 will be building a new station north of the tower. The control tower is an FAA project and at the end of September they will move from the temporary tower to the new one.

VI. Code Enforcement
A. Allen Metz reported that his office is responding to complaints. He suggested that the public should call the Complaint Line rather than speaking to him or another officer. The Complaint Line logs the complaint in a more timely manner.

B. He is working on a complaint regarding 2302 Bristol. He has met with the owner, Mrs. Long. She has 30 days to clean up the site and remove the illegal business on the property. If she does not comply, she will be given a civil citation.

VII. Report From CEO's Office
A. Roger asked Paul Lanning about the AB1290 Bond status. Bond due in 2035 and it limits the time an agency has to issue additional debt. The date for us is 2006.

B. Greg Carroll asked if there is a certain amount of time to use the money in our budget. Paul responded by informing PAC that a redevelopment project area only lasts for a certain amount of time and Santa Ana Height's expires in 2026, but could be extended.

C. Roger Summers inquired about the $10 million of PAC money the airport is holding. It is included in our current budget and is gaining interest. It needs to be removed from the airport's budget to PAC's budget. Paul is waiting for information from the FAA. Holly Veale will look into this.


VIII. Status Report on Teahouse
A. Mark Esslinger reported that the homeowner has pulled permits for a take-out only restaurant and and office. As long as he requests building inspections every 180 days, the permits are good. Everyone agreed that the property owner is dragging his feet on this project. He will have to make certain improvements on Orchard Street.

IX. Report on Birch Corporation Center Project
A. Roger Summers reported that he and four PAC members met with John Baile about painting and sandblasting the glass. Rick Dayton thought it was ok. There was a question raised about the windows facing the REQ. Rick is looking into the new project underway on Birch Street with Micki and the homeowner who raised the question.

X. Report on Annexation
A. David Kiff reported that the Newport Beach City Council is working on the property tax issue for Bay Knolls and Newport Coast. They have not addressed our area yet. They are going to LAFCO with the Newport Coast petition this month. LAFCO wants to consider Costa Mesa and Newport at the same time. West Santa Ana Heights is still fighting the Costa Mesa application. Roger met with city officials in Costa Mesa and his impression was they have drawn the line in the sand and they are going to make LAFCO make the West Santa Ana Heights decision for them. This might bump the decision up to the County if LAFCO sees fit.

B. The question arose about the runway expansion land and what sphere of influence that falls in. Dave said that it is County and not in either Newport or Costa Mesa's sphere, though it would be very beneficial if it was. He did not think the County would release that land.
C. Dave thought the estimated date of annexation to be completed would be July of 2002.


XI. Upper Newport Bay Equestrian Access Issue Report
A. Mark Esslinger got the latest legal documents from Carla Brockman's attorney and he is not going to waste anymore time. They have a meeting set for Monday, August 14th, where the Deputy City Attorney of Newport Beach will be present and they have to either reach an agreement or not. If not, the Fish and Game authorities have a key and may open the gate for access and take this to another level.

Meeting was adjourned at 9:40 p.m.
